1. Provider
Subcheck is provided by:
Josef Moucachen, trading as Synthropy
Overhoeksplein 3
1031 KS Amsterdam
Netherlands
Chamber of Commerce (KvK): 94099660
Email: support@getsubcheck.com
In these terms, “we” and “us” mean the provider. “You” means the person or organization using Subcheck.
2. What Subcheck is and is not
Subcheck reads the public license files of the California Contractors State License Board (CSLB) and the Florida Department of Business and Professional Regulation (DBPR), and shows them in a form that is easier to search and watch.
- We are not a state licensing board, and we do not license, approve, rate or recommend contractors.
- We are not an insurance agency, broker or surety. We do not sell bonds or insurance.
- We do not give legal, insurance or compliance advice.
3. Accepting these terms
You can search Subcheck without an account. By using the site, you agree to these terms. When you create an account or start a Pro subscription, you confirm again that you accept them.
You must be at least 18 and able to enter into a contract. If you use Subcheck for a company, you confirm that you may bind that company to these terms.
4. Accounts and sign-in
You sign in with a link we email you. The link works for 15 minutes. The first link you use creates your account; there is no separate sign-up.
Keep access to your email account secure, because anyone who can read your email can sign in as you. Tell us at once if you think someone else has used your account. One account is for one person; do not share it.
5. Plans and monitoring
You can watch California and Florida licenses. Each day after a new state file loads, we compare it with the last one and email you what changed on the licenses you watch, such as status, bond, workers’ compensation, classifications or the people on the license.
- Free: watch up to 50 licenses, at no cost.
- Pro: $29 a month. Watch as many licenses as you need for normal business use, up to 5,000 per account. Write to us if you need more.
Prices, taxes and the billing period are shown before you pay, and form part of this agreement. Change emails are service messages. You can stop them by removing licenses from your watchlist, with the unsubscribe link in every change email, or by deleting your account.
A change email is a notice, not a guarantee. We send it only after the state publishes a new file. Florida files update about weekly. An email can be late or fail to arrive. Do not rely on Subcheck as your only check.
6. Checkout and payment
Polar Software, Inc. acts as merchant of record and authorized reseller for Pro subscriptions bought through Polar Checkout. Your payment, tax, invoice and checkout transaction are governed by the Polar Buyer Terms. These Subcheck terms remain the agreement that governs your use of Subcheck.
The price, taxes, currency, payment method, renewal period and total amount due are shown before you confirm an order.
7. Renewal and cancellation
Pro renews every month until you cancel. You can cancel at any time under Manage billing on your watchlist page, which opens Polar’s customer portal, or by writing to support@getsubcheck.com.
Cancelling stops future renewals. Pro stays active until the end of the month you paid for. After that, your account moves to Free. If you watch more than 50 licenses then, we keep your list, but you cannot add licenses until it has fewer than 50.
8. Withdrawal and refunds
If you are a consumer in the EU or the UK, you may have a legal right to withdraw from an online purchase within 14 days. For a service that starts at once, that right can end when you ask for the service to start straight away and confirm that you know this. Nothing in these terms takes away a right that the law does not let us exclude.
We do not offer refunds beyond what the law and the Polar Buyer Terms give you. To ask for a refund, write to support@getsubcheck.com. Refunds are paid through Polar.
9. The license data and its limits
All license data on Subcheck comes from public files that CSLB and DBPR publish. We copy them as they are.
- It can be out of date. We load the California file about once a day and the Florida file about once a week. A license can change on the state’s own site before it changes on Subcheck. Each page shows the date of the file it comes from.
- It can be wrong or incomplete. State files can have errors and gaps. Our import can also fail or miss a day.
- We do not guarantee that a license is valid, that a bond or insurance policy is in force, or that a person on a license is who they say they are.
- Check the state’s own lookup before you rely on a license. For California, use the CSLB license check at cslb.ca.gov. For Florida, use DBPR at myfloridalicense.com. The state record decides, not Subcheck.
Decisions about hiring, paying or working with a contractor are yours.
10. License status badge
Each California license page offers a status badge: an image showing the license number and its status from the latest file, linked to the record on Subcheck. You may put the badge on a website if:
- the badge is for your own license, or for a license you have permission to show;
- you use the code we provide, and do not change the image, the status or the link;
- you do not use it to suggest that a state agency or Subcheck approves or recommends you.
The badge shows the status in our latest file, so it can be behind the state record. We may change the badge, or stop serving it, at any time.
11. Acceptable use
Use Subcheck for normal searches and monitoring. You must not:
- scrape, crawl or download Subcheck data in bulk with scripts, bots or other automated tools, beyond what a person using the site would do. Search engines may crawl the site as our
robots.txtfile allows; - resell, republish or redistribute Subcheck data in bulk, or use it to build a competing database or service. The state files are free from CSLB and DBPR; get them there;
- get around the limits of your plan, share an account, or create several accounts to avoid them;
- use the names, addresses or phone numbers in the records for spam, harassment or unsolicited marketing, or in any way that breaks the law;
- use Subcheck to decide whether a person is eligible for credit, insurance, employment or housing, or for any other purpose covered by the US Fair Credit Reporting Act (FCRA). Subcheck is not a consumer reporting agency, and its data is not a consumer report;
- send false quote requests, or a quote request in someone else’s name;
- overload, probe or attack the site, or try to reach data that is not yours.
We may block access that breaks these rules, and may limit the number of requests from one source.
12. Quote requests
Some California license pages show a quote box when the state file shows a bond or insurance problem, such as a suspension for the bond, workers’ compensation or liability insurance, a pending suspension, or a workers’ compensation policy ending within 60 days. The license holder can ask for bond or insurance quotes there.
When you send a request and tick the consent box, we pass your name, email address, phone number (if given) and the license details to a licensed insurance agent we work with, who will contact you. We are not a party to any quote, policy or bond you get. The agent and the insurer or surety are responsible for their advice, prices and products. Send a request only for your own license, or a license you act for.
13. Intellectual property
The state records are public. Subcheck’s software, design, text, logos and the way we arrange the data belong to us or our licensors. These terms give you a limited, non-exclusive, non-transferable right to use Subcheck for your own personal or internal business purposes. They give you no other rights.
14. Liability
Nothing in these terms limits or excludes liability for fraud, intent, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited by law. If you are a consumer, your mandatory rights stay in place.
Within those limits:
- We provide the license data as it appears in the state files, without any warranty that it is correct, complete or current (section 9).
- We are not liable for losses caused by relying on Subcheck data without checking the state record, by a late or missing change email, or by an error in a state file.
- We are not liable for losses that were not reasonably foreseeable when you started using Subcheck. If you are a consumer, we are not liable for business losses.
- If you use Subcheck for a business, our total liability for all claims in any 12 months is limited to the fees you paid us in the 12 months before the claim, or $100 if you use the free plan.
15. Availability and changes to the service
We work to keep Subcheck running, but we do not promise it will always be available or free of errors. State agencies can change, delay or stop publishing their files, which can stop updates for a state.
We may change, add or remove features. We will not reduce Pro in a way that matters to you during a month you have paid for without a valid reason. If we make a change that affects Pro, we will tell you in advance where the law requires it, and you can cancel.
16. Suspension, termination and account deletion
You can stop using Subcheck at any time. You can delete your account on the Account page. Deleting your account removes your watchlist and stops change emails. It does not cancel a Pro subscription at Polar by itself, so cancel Pro first (section 7).
We may suspend or close an account where we have a good reason, such as non-payment, a security risk, unlawful use or a serious breach of these terms. Where it is fair to do so, we will tell you first and give you a chance to fix the problem. If we close a paid account for a reason that is not your fault, we refund the unused part of the month.
Sections that by their nature should last after termination, such as liability and governing law, stay in force.
17. Privacy
Our privacy policy explains how we handle the personal data of users, quote requesters and the people named in the license files.
18. Governing law and disputes
Dutch law applies to these terms. If you are a consumer, this does not take away the protection of mandatory rules in the law of the country where you live. Courts are decided by the applicable law. These terms do not limit a consumer’s right to bring a claim in a court that has jurisdiction.
Please write to support@getsubcheck.com first, so we can try to solve a complaint directly. We are not willing or obliged to take part in proceedings before a consumer dispute resolution body, unless the law requires it.
19. Changes to these terms
We may update these terms for legal, security, technical or product reasons. The effective date at the top shows the current version. If a change affects you materially, we will email account holders at least 30 days before it takes effect. If you do not agree, you can cancel Pro and delete your account before then. Changes do not take away rights you already have.
